Defining
"Enemy
of the state"
By: Ed Lewis - January 6, 2005
People presume that "enemy of
the state" is a man or woman or organization that is against
the government. I maintain that is 100 percent wrong. First, we
must consider the definition of "state". Is state the
government? Or, is it something else? "STATE, government.
This word is used in various senses. In its most enlarged sense,
it signifies a self-sufficient body of persons united together in
one community for the defence of their rights, and to do right
and justice to foreigners. In this sense, the state means the
whole people united into one body politic; (q. v.) and the state,
and the people of the state, are equivalent expressions. 1 Pet.
Cond. Rep. 37 to 39; 3 Dall. 93; 2 Dall. 425; 2 Wilson's Lect.
120; Dane's Appx. §50, p. 63 1 Story, Const. §361."
Bouvier's Law Dictionary, 1856 (My emphasis)
Then, we also have this definition by Bouvier ~ "In a more
limited sense, the word `state' expresses merely the positive or
actual organization of the legislative, or judicial powers; thus
the actual government of the state is designated by the name of
the state; hence the expression, the state has passed such a law,
or prohibited such an act. Also, from Bouvier is that,
"State also means the section of territory occupied by a
state, as the state of Pennsylvania." Then, of course, we
have "Nation-state", which is actually what each state
of the united States of America is. It is defined as: "...A
political unit consisting of an autonomous state inhabited
predominantly by a people sharing a common culture, history, and
language.... The American Heritage Dictionary of the English
Language, 4th Edition, 2000.
Thus, we must also examine the meaning of "autonomous".
According to the American Heritage Dictionary, supra, it means:
"1. Not controlled by others or by outside forces;
independent: an autonomous judiciary; an autonomous division of a
corporate conglomerate. 2. Independent in mind or judgment;
self-directed" Autonomous can also be an adjective to
"state" with "state" as a noun. As a noun,
"state" can mean: 1. "A condition or mode of
being, as with regard to circumstances: a state of
confusion"; 3. A mental or emotional condition: in a manic
state" 4. Informal A condition of excitement or distress. 6.
Social position or rank.
Let us understand this. The Constitution (in case you do not
know, amendments become part of the Constitution via Article V)
states in the 2nd Amendment that: 'A well regulated Militia,
being necessary to the security of a free State, the right of the
people to keep and bear Arms, shall not be infringed." Our
founders could have used "State" in one of three ways,
or two ways simultaneously. Since the states are the people, and
are used interchangeably as such, then one could presume that
this is the case; that is, that the meanings of being the people
with commonalities, or as the people in a given geographic area
acting in common. The least likely use is any referral to a
government. The reason is because of the words
"autonomous" and "free". Logically, the State
as the government (see above limited meaning by Bouvier) is not
free, as it is to be controlled by the sovereignty making up the
state, or the people. Fictions, such as State governments are,
have no rights as they exist only in our minds. They cannot be
damaged; they cannot live freely; they cannot rule over the
people; they cannot be on an equal footing with the people; and
they as fictions lacking brain matter cannot reason determining
self-will. Only human being can do these things.
Thus, it is my conclusion - and any who wish to do so can present
their argument for otherwise - that State as used in the
Constitution means either the people or the geographic area made
up of people with common interests and so on. It does not mean -
nor can it ever mean - a STATE incorporated government.
"The Constitution was written to be understood by the
voters; its words and phrases were used in their normal and
ordinary, as distinguished from technical, meaning; where the
intention is clear, there is no room for construction, and no
excuse for interpolation or addition. . . . The fact that an
instrument drawn with such meticulous care and by men who so well
understood how to make language fit their thought does not
contain any such limiting phrase . . . is persuasive evidence
that no qualification was intended." Reid v Covert, 354 U.S.
1; United States v. Sprague, 282 U.S. 716, 731-732 (quoting
Reid). Further supporting this is that we people elect
representatives to "represent" us (thus, are fictions)
but give them NO power or authority to contradict the exercise of
our unalienable rights bestowed upon us by our Maker and secured
by the limitations placed on government by the Constitution. They
may only regulate what they are given authority to regulate and
govern, which are corporations and other fictions at law. We
people are in fact self-governing, with all created equal to one
another.
Thus, one might contend, for example, that the 2nd Amendment is
actually a statement of necessity prohibiting government from
infringing upon our right to defend "our" free
"state of being" from encroachment by greedy, power
lusting representatives (fictions by definition since they are
not the real
people).
I repeat: "STATE, government. This word is used in various
senses. In its most enlarged sense, it signifies a
self-sufficient body of persons united together in one community
for the defence of their rights, and to do right and justice to
foreigners. In this sense, the state means the whole people
united into one body politic; (q. v.) and the state, and the
people of the state, are equivalent expressions. 1 Pet. Cond.
Rep. 37 to 39; 3 Dall. 93; 2 Dall. 425; 2 Wilson's Lect. 120;
Dane's Appx. §50, p. 63 1 Story, Const. §361." Bouvier's
Law Dictionary, 1856 (My emphasis)
Now the question becomes how can the people when righting wrongs
done by government entities against the people - or attempting to
right wrongs done by officials, agencies of, and so on - be an
enemy of the state, since we are the state? I assure you that
anytime a government mouthpiece, whether an elected or
appointed official, or a hired agent of the STATE (cops, for
example), speaks of "enemies of the state", he refers
to those being the enemy of the traitorous government he is part
of. Or, perhaps he is paid handsomely to tell lies publicly
and/or to practice daily treason against the people by using
force of
arms and other extortive means to force compliance. At any rate,
the government (STATE OF MISSOURI, for example) does not want its
racketeering schemes interfered with, and therefore the
representatives and
"agents of" do everything they can to turn other people
against the actions of those with the courage to face the armed,
deadly and unconstitutional resistance of government entities to
the rule of law and subsequent righteousness.
Therefore, it is my contention that the true enemies of the state
are the very government entities and their agencies that should
be constitutionally created to protect the people, who are by
definition the state. These representatives are undermining
American freedom using fraud, force, mail fraud, extortion,
malicious prosecution, obstruction of justice, amotion,
misinformation, disinformation, malfeasance, misfeasance,
nonfeasance, acting ultra virus (leads to under color of
authority criminal and civil violations), and other civil
techniques and criminal acts that have been used for the past 150
years by unscrupulous greedy, power-lusting officials. By the
way, "leaders" is a misnomer. They represent us in the
task of taking care of public (our) property and regulating
artificial entities, but they are not our "leaders", as
in "rulers" or "controlling entities". We
must quit ceding our rights - or trading them for privileges
granted to corporations - to our mere representatives that are
lawfully in servitude to us, and, therefore, subservient to us.
I might add that no government owns property within the
boundaries of the states - all is public property of the people
(state but not STATE OF _____ or the CITY OF ____ or the COUNTY
OF _____) with the privilege to govern certain property when the
people authorize jurisdiction of the area by elected
representatives.
As for the federal government in taking over 50 percent of the
landmass of the states, where in the Constitution is the federal
government given the authority to regulate any land or property
within the states, other than for armories, forts, needful
buildings, and ports? It is a lie, People, and a big lie that the
feds can OWN our property, whether public or private. It is also
armed theft, as always the feds result to the use of deadly
weapons to coerce, whether it is deadly hand-to-hand techniques
or firearms. The federal government - and the STATE OF _____
governments - has completely fooled the people in order to keep
the people off land and other property owned by the people. Get
this - that means they took the American land in plain sight
right from under our noses. Shame, shame, shame on us.
Government does not own our highways, roads, alleys, or any other
name given to a cleared and surfaced path for "our"
travel. We own them and only authorize the STATE (not the feds as
it is not in authorized activities stated in Article I, Section 8
of the Constitution for the united States of America) to repair
and regulate the transport of goods on our roads by commercial
carriers (vessels) and drivers (one hired to transport goods).
Thus, when a STATE or fed brings up "enemy of the
state", just think of them as looking in the mirror, as it
is they that are infringing upon our rights and committing
treason against us - a domestic invasion if you will. Then do
your duty, and file suits or criminal charges against those who
would destroy your - our - freedom and the united States of
America.
You are not alone, although it will often seem that way.
Do not fear, even though they might persecute, prosecute, or even
kill you. It is better to die for a worthy cause for mankind and
Natural Law than to shrivel away living daily with the knowledge
that one is acting as a coward acts, sitting back and waiting for
others to do what every American should be doing. Remember
"home of the brave". Without courage, there can be no
"land of the free".
